These Terms and Conditions (“Terms”) apply to all offers, quotations, orders, and sales of rugs, carpets, and related products (“Products”) by Decor by Persia (“we,” “us,” or “our”). By placing an order, requesting a custom piece, or using our services, you (“you” or “Customer”) agree to these Terms.
Terms and Conditions
Terms governing the sale of handmade and custom Persian rugs and carpets through Decor by Persia.
1. Nature of our products
Our Products are predominantly hand-knotted, hand-woven, or otherwise artisan-made. Natural materials (such as wool, silk, cotton, and dyes) and manual workmanship mean that each piece is unique. Minor variations in colour, pattern alignment, pile height, sheen, and dimensions are inherent characteristics of handmade goods, not defects. Samples, photographs, and digital renderings are indicative only; finished pieces may differ within normal artisan tolerances.
2. Orders, quotations, and acceptance
A quotation is an invitation to treat and does not bind us until we confirm your order in writing (including by email or message). We may decline or cancel an order before production or shipment for reasons including availability of materials, capacity, or concerns about accuracy of specifications. You are responsible for the accuracy of sizes, designs, colours, and delivery details you provide.
3. Custom and made-to-order pieces
Custom, bespoke, or made-to-order rugs are produced specifically for you based on agreed specifications. Once you approve the final specification (including design, size, materials, and colour direction) and we commence production, the order is generally non-cancellable except where we agree otherwise in writing or where required by applicable law. Deposits or progress payments for custom work are typically non-refundable once allocated to materials or production, as they cover committed artisan time and materials.
4. Price and payment
Prices are as quoted in the currency stated and may exclude taxes, duties, shipping, insurance, and installation unless expressly included. We may require a deposit before starting custom production and balance payment before dispatch or as otherwise agreed. If payment is late, we may suspend work or shipment and charge statutory or contractually permitted interest and recovery costs where applicable.
5. Lead times and delivery
Stated lead times and delivery dates are good-faith estimates, not guarantees. For in-stock rugs and artistic rug frames ready for dispatch, international delivery is typically 10–15 business days, depending on destination country and customs clearance. Handmade production, weather, shipping congestion, customs clearance, and force majeure events can cause delay. We will use reasonable efforts to keep you informed of material delays. Time is not of the essence unless we have confirmed a fixed date in writing as binding. For full shipping details, see our Shipping & Delivery page.
6. Shipping, risk, and title
Delivery terms (e.g., ex-works, CIF, DAP) and the point at which risk passes will be as stated in your order confirmation or commercial invoice. Unless otherwise agreed, risk of loss or damage passes to you when the Product is delivered to the carrier or to your designated address, per the agreed Incoterm or shipping terms. Title may pass on full payment of all amounts due, as specified in your order documents. For full shipping details, see our Shipping & Delivery page.
7. Inspection and claims
You should inspect Products promptly upon receipt. Any claim for transit damage, shortage, or manufacturing defect that is reasonably visible must be notified in writing within a reasonable period (we recommend within seven (7) days of delivery) with clear photographs and a description of the issue. Failure to notify within that period may affect your ability to assert a claim, subject to applicable mandatory consumer rights.
8. Returns, exchanges, and refunds
Because handmade and custom Products are often unique or made to your specifications, they are typically final sale once production has started or once delivered, except where a mandatory right of withdrawal applies in your jurisdiction or we agree otherwise in writing. Stock or non-custom items may be eligible for return or exchange only on the terms stated at the time of purchase (e.g., unused condition, original packaging, return shipping at your cost). Refunds, when due, will be processed using the original payment method where practicable. For complete return and refund terms, see our Return & Refund Policy.
9. Care, use, and cleaning
Proper care is essential. Follow any care instructions we provide. Professional cleaning methods suitable for natural fibres and dyes are recommended. Damage from improper cleaning, excessive moisture, pets, furniture dragging, burns, or normal wear is not covered under our limited warranty below.
10. Limited warranty
We warrant that Products will materially conform to the agreed specification at delivery and be free from material manufacturing defects under normal domestic use for a reasonable period from delivery, as stated in your order confirmation or applicable product documentation. This limited warranty does not cover normal ageing, shedding, colour softening, or issues arising from misuse, accidents, or unauthorised alteration. Our sole obligation for a valid warranty claim, at our option, is repair, replacement, or a partial refund of the purchase price for the affected Product.
11. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profit, goodwill, or data. Our aggregate liability arising out of any order is generally limited to the amount you paid us for that Product, except where liability cannot be limited by law (including death or personal injury caused by negligence, or fraud).
12. Force majeure
We are not liable for delay or failure to perform due to events beyond our reasonable control, including natural disasters, war, terrorism, labour disputes, pandemics, government actions, material shortages, or failures of carriers or utilities.
13. Intellectual property
Designs, photographs, branding, and content we provide remain our intellectual property or that of our licensors. You may not copy or use them for commercial purposes without our written consent. Custom designs created for you may be subject to separate licence terms as agreed.
14. Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which Decor by Persia operates its business, without regard to conflict-of-law rules. Courts in that jurisdiction shall have non-exclusive jurisdiction, unless mandatory consumer protection rules in your country require otherwise. Where permitted, you and we agree first to attempt good-faith resolution of disputes through direct contact before initiating formal proceedings.
15. Changes
We may update these Terms from time to time. The version posted on our website at the time of your order generally applies to that order. Material changes will be indicated by updating the page and, where appropriate, the “last updated” date below.
